In the proceedings taken before April, the evidence of Captain Bruce, then Superintendent of Police, (a copy of which is attached), showed that there had been in his possession a Bill and some money belonging to the Prisoner Brennan, and I perfectly well remember that Captain Bruce offered the Bill to keep, which I also remember declining. I have no recollection of Captain Bruce having ever paid the Bill or money to me, nor is there either in the Treasury or Office of the Chief Magistrate any clue to the transaction.

By the enclosed correspondence obtained through Mr Bay, the Registrar of the Supreme Court, it is clear that the money in question was offered to that officer by Captain Bruce in November following, and that it was not received then into the Supreme Court; and as the property of Felons becomes forfeited to the Crown, I am at a loss to imagine how or why the Bill should have been paid to me, as is stated in Captain Bruce's letter of the 18th December, 1848, to the Right Honble. the Earl Grey, when the natural channel for such waifs is the Supreme Court. I have no doubt from my own long personal acquaintance with Captain Bruce, that he is under the impression that the Convict's money was paid to me, but I beg distinctly to observe that I have no recollection of the matter, beyond what I have already stated, nor is there any document of which I am cognizant showing such payment to have been made at all.

It is possible that a reference to the 98th Regiment might clear the matter up; but I have failed in obtaining any information here, either through the Major
